Abstract

The advancement of assisted reproductive technology, particularly embryo cryopreservation, poses unprecedented challenges to the classical Islamic legal framework governing lineage (nasab) and inheritance (mīrāth). Traditional fiqh establishes nasab through a valid marriage contract and confirmed pregnancy within legally recognised temporal parameters. However, the possibility of implanting a frozen embryo years after the husband's death fundamentally disrupts the biological and temporal assumptions embedded in classical jurisprudence. This article critically examines whether a cryopreserved embryo, conceived in vitro during the husband's lifetime but implanted posthumously, can legitimately establish nasab to the deceased father and, consequently, claim inheritance rights under farāʾiḍ. Employing a doctrinal analytical methodology with comparative ijtihād across the four Sunnī schools and contemporary fatwa institutions, this study argues that the existing fiqh framework requires significant reinterpretation. The article proposes a nasab based typology distinguishing between pre-implantation and post-implantation legal status, and offers a reconceptualised model harmonising ḥifẓ al-nasl, the rights of the unborn, and distributive justice in Islamic inheritance law.
